By accessing or using Property Searcher (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. The Service is operated by Property Searcher ABN [to be inserted] (“we”, “us”, “our”).

2. Description of Service

Property Searcher is a property search aggregation platform that monitors publicly available property listing websites across Australia. We provide automated matching of listings to your saved search criteria and deliver notifications via email and push notifications.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person or legal entity may not maintain more than one free account

4. Subscriptions and Payments

• Paid subscriptions are billed monthly via Stripe
• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods
• We reserve the right to change pricing with 30 days notice

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to scrape, copy, or redistribute data from the Service
• Interfere with or disrupt the Service or its infrastructure
• Create multiple free accounts to circumvent plan limits
• Use automated tools to access the Service without our permission
• Resell or redistribute the Service without our written consent

6. Property Listing Data

Important disclaimers about property listing data:

• We aggregate listings from third-party websites and do not verify their accuracy
• Property details including price, size, and availability may be outdated or incorrect
• We provide direct links to original listings — always verify details with the listing agent
• We are not a real estate agent and do not facilitate property transactions
• Match scores are algorithmic estimates and should not be solely relied upon for purchasing decisions

7. Intellectual Property

The Service, including its design, code, and branding, is owned by Property Searcher. Property listing content belongs to the respective listing sources. You retain ownership of any data you provide (search criteria, saved preferences).

8. Limitation of Liability

To the maximum extent permitted by Australian law, Property Searcher shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. Scheduled maintenance will be communicated in advance where possible.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.

12. Changes to Terms

We may update these terms from time to time. Material changes will be notified via email. Continued use of the Service after changes constitutes acceptance.
